Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the websites, software products and services provided by 5S Infotech("we", "us"), including 5S Whatapi, 5S GMB Suite, RentFlow and custom development services. By creating an account, purchasing a subscription or using our services, you agree to these Terms.

2. Services and subscriptions

  • Subscriptions are billed monthly in advance, in the currency selected at purchase (INR for Indian customers, USD for international customers). The billing currency is fixed for the life of the subscription.
  • Prices for each currency are set independently and may differ; they are not currency conversions of each other.
  • We may revise pricing with at least 30 days' notice before your next billing cycle.
  • Usage-based charges (such as WhatsApp conversation charges set by Meta) are billed as applicable and are separate from platform subscription fees.

2A. Free trials

  • Eligible plans include a 15-day free trial. No payment method is required to start a trial, and nothing is charged automatically when the trial ends.
  • One free trial per plan per customer/email. We may withdraw or limit trials in cases of misuse.
  • At the end of the trial, continue by purchasing a subscription — otherwise the trial account is deactivated and its data handled per Section 7.

2B. Service delivery & activation

Our products are delivered digitally — there is no physical shipping. After successful payment (or trial signup), your account is activated and login details are sent to your registered email, normally within a few hours and no later than 24 hours. If you do not receive access within 24 hours, contact us on WhatsApp or at hello@5sinfotech.in and we will resolve it on priority.

3. Acceptable use

  • You must comply with all applicable laws and with third-party platform policies, including the WhatsApp Business Messaging Policy and Google's terms, when using our products.
  • Spam, unsolicited bulk messaging to users who have not opted in, and unlawful, fraudulent or harmful content are prohibited and may result in immediate suspension.
  • You are responsible for obtaining valid consent from your customers before messaging them.

4. Your data

You retain ownership of the data you and your customers submit to our platforms. We process it only to provide the services, as described in our Privacy Policy. You are the data controller for your customer data; we act as processor.

5. Custom development

Custom projects are governed by a separate written proposal or agreement specifying scope, deliverables, timelines and payment terms. Unless agreed otherwise in writing, intellectual property in bespoke deliverables transfers to you on full payment, excluding our pre-existing platforms, tools and libraries.

6. Availability and support

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance where practical. Support is provided via WhatsApp and email.

7. Termination

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We may suspend or terminate accounts that violate these Terms. On termination, we will make your data available for export for 30 days, after which it may be deleted.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to the services is limited to the amounts you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental or consequential damages, or for actions taken by third-party platforms (including Meta or Google) affecting your accounts on those platforms.

8A. Payments, billing descriptor & chargebacks

  • Payments are processed by Razorpay (INR) and PayPal (USD). We do not store your card or banking details.
  • Charges on your statement will appear under our business name or our payment processor's descriptor.
  • If you believe a charge is incorrect, contact us first at hello@5sinfotech.in or on WhatsApp — most billing issues are resolved within 2 business days, faster than a bank dispute. Chargebacks raised without contacting us may lead to account suspension while the dispute is investigated.

9. Governing law

These Terms are governed by the laws of India. Courts at our registered place of business shall have exclusive jurisdiction, subject to any mandatory consumer protections applicable in your country of residence.
